TUPE, the Acquired Rights Directive and Flexibility: Changing Terms, and Reducing Headcount, Across Europe

Publié vendredi 21 mars 2014

Ius Laboris is pleased to announce its second International Workshop Series. This series will focus on the question of how much flexibility employers have to make dismissals and change terms and conditions following a transfer under the Acquired Rights Directive / TUPE.
Ius Laboris lawyers from five countries will deliver this joint seminar in four different locations. You are invited to attend any of them.

Some of the topics that will be addressed at the workshop are:

–– To what extent can a new employer change employment conditions to realise savings or to restructure the business? What are the risks of getting it wrong?
–– How important are the terms of employment contracts and CBAs? How much flexibility can they give you?
–– How easy (or not) is it to dismiss newly-acquired employees? What are the practical steps you can take to manage the risks?
–– How far does the economic context influence the flexibility that can be expected from employees?
–– How important is it to secure the agreement of Works Councils, trade unions and other employee bodies?
–– How far can commercial agreements take you in getting around TUPE / ARD protections? What should you ask for?
