LL.M. Polnisches Wirtschaftsrecht (Polish Business Law)

Bewerbung

Notwendige Unterlagen zur Bewerbung (verbindliche Angaben finden sich nur in der Studiengangssatzung):
  • Ausgefüllter Personalbogen (zum download siehe oben) 
  • Amtlich beglaubigte Kopie des Hoschschulabschlusses (1. Staatsexamen ODER eine offizielle Bestätigung des Abschlusses des Jura-Studiums) samt Übersetzung durch einen Konsul der Republik Polen oder einen gerichtlich vereidigten/bestellten Dolmetscher
  • Lebenslauf (tabellarisch, in Deutsch oder Polnisch)
  • Bestätigungen des wissenschaftlichen und beruflichen Engagements (Publikations-, Vortragsliste (in Deutsch oder Polnisch), Praktikabestätigungen, etc.)

Programm

Erster Programmblock: Anfang März bis Ende Juni

Die Lehrveranstaltungen in deutscher Sprache (gesamt mindestens 280 Stunden) im Bereich des polnischen Wirtschaftsrechts finden im ersten Semester des Aufbaustudienganges in Krakau statt (Anwesenheitspflicht) und u.a. umfassen Vorlesungen in folgenden Fächern:

 

  • Zivilrecht – Allgemeiner Teil und Schuldrecht - 40 Stunden, 5 ECTS-Punkte
  • Zivilrecht – Sachenrecht - 30 Stunden, 4 ECTS-Punkte
  • Privates Wirtschaftsrecht - Gesellschaftsrecht - 30 Stunden, 4 ECTS-Punkte
  • Öffentliches Wirtschaftsrecht - 30 Stunden, 4 ECTS-Punkte
  • Internationales Privatrecht - 20 Stunden, 3 ECTS-Punkte
  • Insolvenzrecht - 20 Stunden, 3 ECTS-Punkte
  • Arbeitsrecht - 20 Stunden, 3 ECTS-Punkte
  • Verfassungsrecht (Einführung in das Verfassungsrecht, verfassungsrechtliche Grundsätze der Gewerbetätigkeit, Organisation der Justiz in Polen) - 20 Stunden, 3 ECTS-Punkte
  • Verwaltunsgsrecht - 20 Stunden, 3 ECTS-Punkte
  • Seminar/case study
  • Geschichte, Kultur und Politik Polens
  • Intensivsprachkurs Polnisch
  • Zweiter Programmblock: Anfang Oktober bis Ende Februar

Zweiter Programmblock: Anfang Oktober bis Ende Februar

Im zweiten Semester des LL.M.-Aufbaustudienganges findet in Krakau ein zweitägiges Intensiv-Diplomseminar (Anwesenheitspflicht) statt, das Unterricht umfasst zum Thema: Zugang zu und Anwendung von polnischen Fachliteratur und Rechtsprechung sowie Art und Weise der Vorbereitung und Durchführung von Recherchen und wissenschaftlicher Arbeit sowie Konsultationen mit dem wissenschaftlichen Betreuer. Zudem erfolgt im zweiten LL.M.-Semester die Abfassung (keine Anwesenheitspflicht in Krakau) einer mindestens 30seitigen Diplomarbeit im Bereich des polnischen Wirtschaftsrechts (Sprache der Arbeit: grds. Polnisch, Deutsch auf Antrag hin möglich).

 

Abschlusszeitpunkt

Das Programm ist abgeschlossen mit der Bewertung der LL.M.-Arbeit durch den wissenschasftlichen Betreuer. Die Arbeit ist bis Ende Februar einzureichen, die Bewertung der Arbeit erfolgt im März, die Abschlussbestätigung wird in der Regel spätestens bis Ende Mai erteilt.

Application

Necessary documents for application (binding information can be found only in the degree program statute): 
  • A completed personal information sheet 
  • Certified copy of the Hosch school (1st State Examination OR an official confirmation of the completion of the law degree) together with translation by a Consul of the Republic of Poland or a court-certified / appointed interpreter 
  • CV (in German or Polish) 
  • Confirmations of the scientific and professional engagements (publication, presentation list (in German or Polish), internships confirmations, etc.) 
  • Copy of the identity card / passport 
  • Two recent passport photos

Study Programme

First Semester: beginning of March to end of June 


The courses are in German language (total at least 280 hours). They  include lectures in the following subjects: 
 

  • Civil Law - General civil law & the law of obligations - 40 hours 5 ECTS points 
  • Civil law - Property law - 30 hours, 4 ECTS credits 
  • Private Business Law - Corporate Law - 30 hours, 4 ECTS credits 
  • Public Business Law - 30 hours, 4 ECTS credits 
  • Private International Law - 20 hours, 3 ECTS 
  • Bankruptcy Law - 20 hours, 3 ECTS 
  • Labor - 20 hours, 3 ECTS 
  • Constitutional law (introduction to the constitutional law, constitutional principles of commercial activity, organization of the judiciary in Poland) - 20 hours, 3 ECTS 
  • Seminar / case study 
  • History, culture and politics of Poland 
  • Intensive Polish Language Course 

Second Semester: beginning of October to end of February 


The second semester of the LL.M. takes place in Krakow and includes a two-day intensive graduate seminar (compulsory attendance). The instruction includes the theme: access to and use of Polish literature, case law, conduct of research, scientific work and consultations with the academic supervisor. In addition, in the second semester of the LL.M., you will have to write at least a 30-page thesis about  the Polish economic law (language of work is Polish ; German is possible on request). 
 

Completion time


The program is completed with the assessment of the LL.M. work by the supervisor. The work has to be submitted by the end of February. The evaluation of the work done in March is normally issued at the latest by the end of May.
